If you do not agree with these Terms, please do not use the App.<\/p><h2>1. Use of the App<\/h2><p>You may use the App only for lawful purposes and in accordance with these Terms.<\/p><p>You agree not to:<\/p><ul><li><p>Use the App for illegal or unauthorized purposes.<\/p><\/li><li><p>Attempt to gain unauthorized access to the App, its systems, or other users&#8217; accounts.<\/p><\/li><li><p>Interfere with or disrupt the App or its underlying infrastructure.<\/p><\/li><li><p>Upload or transmit malicious software, viruses, or harmful code.<\/p><\/li><li><p>Abuse, exploit, or circumvent any security or access controls.<\/p><\/li><\/ul><h2>2. User Accounts<\/h2><p>Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.<\/p><p>You agree to provide accurate information and to notify us if you believe your account has been accessed without authorization.<\/p><h2>3. User Content<\/h2><p>If you submit, upload, or otherwise provide content to the App (&#8220;User Content&#8221;), you retain ownership of that content.<\/p><p>By submitting User Content, you grant us the limited rights necessary to host, store, process, display, and otherwise use that content solely to provide and operate the App.<\/p><p>You are responsible for ensuring that you have the necessary rights to any User Content you submit.<\/p><h2>4. Prohibited Activities<\/h2><p>You may not use the App to:<\/p><ul><li><p>Violate applicable laws or regulations.<\/p><\/li><li><p>Infringe another person&#8217;s intellectual property or privacy rights.<\/p><\/li><li><p>Harass, threaten, or harm others.<\/p><\/li><li><p>Attempt to compromise the security of the App or its infrastructure.<\/p><\/li><li><p>Circumvent usage restrictions or access controls.<\/p><\/li><li><p>Use the App in a manner that could damage, disable, or overburden our services.<\/p><\/li><\/ul><h2>5. Intellectual Property<\/h2><p>The App, including its software, design, branding, logos, and other materials, is owned by or licensed to\u00a0<strong>Fizz N Energy LLC<\/strong>\u00a0and is protected by applicable intellectual-property laws.<\/p><p>Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works from the App or its materials.<\/p><h2>6. Third-Party Services<\/h2><p>The App may use third-party services, including Google Cloud Platform and other providers.<\/p><p>Your use of third-party services may be subject to those providers&#8217; separate terms and policies. We are not responsible for third-party services that are outside our control.<\/p><h2>7. Availability<\/h2><p>We may modify, suspend, or discontinue all or part of the App at any time.<\/p><p>We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.<\/p><h2>8. Disclaimer<\/h2><p>The App is provided on an &#8220;as is&#8221; and &#8220;as available&#8221; basis to the extent permitted by law.<\/p><p>We make no warranties, express or implied, regarding the App&#8217;s availability, reliability, accuracy, or fitness for a particular purpose, except where such warranties cannot legally be excluded.<\/p><h2>9. Limitation of Liability<\/h2><p>To the maximum extent permitted by applicable law,\u00a0<strong>Fizz N Energy LLC<\/strong>\u00a0will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.<\/p><p>Our total liability arising from your use of the App will be limited to the amount you paid us for the App during the\u00a0<strong>12-month<\/strong>\u00a0period preceding the event giving rise to the claim, or the minimum amount permitted by applicable law if you have paid nothing.<\/p><h2>10. Termination<\/h2><p>We may suspend or terminate your access to the App if you violate these Terms or if we reasonably believe that your use of the App creates a security, legal, or operational risk.<\/p><p>You may stop using the App at any time.<\/p><p>Sections that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, and dispute resolution, will survive termination.<\/p><h2>11.
