These Terms of Service (“Terms”) govern your use of Fizz N Energy LLC Google Cloud App (“the App”), operated by Fizz N Energy LLC (“we,” “us,” or “our”).
By accessing or using the App, you agree to these Terms. If you do not agree with these Terms, please do not use the App.
1. Use of the App
You may use the App only for lawful purposes and in accordance with these Terms.
You agree not to:
Use the App for illegal or unauthorized purposes.
Attempt to gain unauthorized access to the App, its systems, or other users’ accounts.
Interfere with or disrupt the App or its underlying infrastructure.
Upload or transmit malicious software, viruses, or harmful code.
Abuse, exploit, or circumvent any security or access controls.
2. User Accounts
Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You agree to provide accurate information and to notify us if you believe your account has been accessed without authorization.
3. User Content
If you submit, upload, or otherwise provide content to the App (“User Content”), you retain ownership of that content.
By submitting User Content, you grant us the limited rights necessary to host, store, process, display, and otherwise use that content solely to provide and operate the App.
You are responsible for ensuring that you have the necessary rights to any User Content you submit.
4. Prohibited Activities
You may not use the App to:
Violate applicable laws or regulations.
Infringe another person’s intellectual property or privacy rights.
Harass, threaten, or harm others.
Attempt to compromise the security of the App or its infrastructure.
Circumvent usage restrictions or access controls.
Use the App in a manner that could damage, disable, or overburden our services.
5. Intellectual Property
The App, including its software, design, branding, logos, and other materials, is owned by or licensed to Fizz N Energy LLC and is protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works from the App or its materials.
6. Third-Party Services
The App may use third-party services, including Google Cloud Platform and other providers.
Your use of third-party services may be subject to those providers’ separate terms and policies. We are not responsible for third-party services that are outside our control.
7. Availability
We may modify, suspend, or discontinue all or part of the App at any time.
We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.
8. Disclaimer
The App is provided on an “as is” and “as available” basis to the extent permitted by law.
We make no warranties, express or implied, regarding the App’s availability, reliability, accuracy, or fitness for a particular purpose, except where such warranties cannot legally be excluded.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Fizz N Energy LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.
Our total liability arising from your use of the App will be limited to the amount you paid us for the App during the 12-month period preceding the event giving rise to the claim, or the minimum amount permitted by applicable law if you have paid nothing.
10. Termination
We may suspend or terminate your access to the App if you violate these Terms or if we reasonably believe that your use of the App creates a security, legal, or operational risk.
You may stop using the App at any time.
Sections that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, and dispute resolution, will survive termination.
11. Privacy
Your use of the App may involve the collection and processing of personal information.

12. Changes to These Terms

These Terms will be governed by the laws of Iowa/United States, without regard to its conflict-of-law principles, unless applicable law requires otherwise.
Any disputes will be handled in the courts located in Polk, Iowa/United States, unless applicable law requires a different forum.
